Docks South, LLC warrants and guarantees to the Purchaser that all materials and fixtures will be new unless otherwise specified, and that all work will be of good quality and free from faults or defects and in accordance with the requirements of the plans, specifications, and drawings.
After final payment is made pursuant to the Agreement and prior to the expiration of five years after the date of Completion, on notice from the Purchase, Docks South, LLC shall, without cost to the Purchaser, remedy any defects in workmanship and materials, provided, however, that Docks South, LLC shall not be responsible for conditions, defects, or damage to the dock that are the result of contraction, expansion, other normal or ordinary characteristics of building materials, Acts of God, damage caused by negligence or improper use of the Dock or normal wear and tear. Cable and jacks are not covered by this Warranty.
